Supreme Court suspends extension notice for extending the term of Army Chief General Qamar Javed Bajwa.
During the tenure of Army General Qamar Javed Bajwa and against the appointment filed by Riaz Hanif Rahi, the applicant did not present himself and requested the court to withdraw the application which was rejected by the court.
Chief Justice Pakistan said that under (3) 184, the petition is being automatically converted into notice.
The court said that it was hearing the petition under 184th, because the question raised in the petition was a question of public interest and therefore it has been fixed for hearing.
On this occasion, Attorney General of Pakistan Anwar Mansoor himself appeared before the court and submitted several documents.
Listening to the petition under Section 184, because the question raised in the petition is a question of public interest and therefore it has been set for hearing.
On this, the court said that with the help of the Attorney General, the documents were reviewed and noted that the summary was sent by the Ministry of Defense, which was sent to the Army Chief for three years for appointment and extension.
Chief Justice Pakistan said that it came after that it was the authority of the President under Article 243 of the Constitution.
The court said that all this process was reversed, first the cabinet approval is required and then the whole matter should be done and then Prime Minister advises to the President is considered as later step.
Later, the court adjourned the Army Chief’s appointment notification and adjourned the hearing till tomorrow.
