I am a PTI supporter and am honestly baffled by this decision from Imran. It is clear that Sheikh Rashid will extract maximum mileage out of it to get elected as he can now claim support of the largest current political force in Pakistan. But it is not clear what Imran will get other than sarcastic remarks by the likes of Shilpa Shetty, sorry Najam Sethi, and politically charged accusations by its opponents? I really hope there is something I am missing; otherwise it looks like a bad deal to me.

yesterday zardari annouced to give national award to jugno mohsin wife of najam sethi . Anybody know whats her achievment for pakistan to get that national award.
Sethi Sahab is right but he cannot say the real facts openly that Establishment is supporting imran khan. I am still a fan of Imran khan but gradually i am getting disappointed that , imran khan talks about CHANGE CHANGE all the time But he is collecting all the typical old politicians of 1970s . A big clue to this fact is all the parties and leaders which are supporting Difa-e-pakistan Council are actually the Pawns of Establishment ? Agencies. Sheikh Rasheed openly admits to be on the side of establishment thats why he uses harsh words against PPP, Hussain Haqqani and nver talks about Taliban. Imran khan never talks against Taliban. Jumaat-e-Islami already are Taliban by themselves . Hameed Gul and Sami-ul-Haq are also part of the Group. I think , Pakistan has no good hopes , because we can already see that Agencies are playing the game . That is the reason that Nawaz Sharif and ANP etc are supporting the Governement ( PPP ) because they know that Democracy is still better than the agents of Pakistan Army which is actually a cancer for Pakistan politics.

Mr. Najam Sethi should conduct a live television debate between the leaders of each party and let people of Pakistan determine whom they trust to lead them from the pit of abysmal failure to the heights of Himalayas Mountains. A nation whose leader is respected and trusted. A leader who is not self serving, worried about his personal net profit margin but that of its people and nation. The people of Pakistan need to rise up again for their freedom as our fore fathers did with Quaid-e-Azam. Allah seldom gives any nation another chance. Iftikhar Chaudhry has distorted the very concept of democracy by ousting a prime minister from his office. This is similar to what armed forces do when they bring in a coup.
If an intellectually weak person is given unrestricted power, he or she can wreak havoc of the whole system. If a criminal’s crimes are forgotten, and an assumption is made that he’ll never repeat his old crimes, such an assumption is naive. Furthermore, it’s more naive to believe that a person, who came into power on army’s and (Punjabi) establishment’s payroll, will execute justice without prejudice.
Iftikhar Chaudhry in his three and a half year tenure has proved that he is incapable of understanding democracy, justice, and rule of law.
He made a mockery of justice when he started taking Suo Motto notices on petty issue. Self-motivated legal actions were taken on issues like a woman secretly possessing alcohol and I.G traffic was called into the court because of traffic problems inIslamabad. He made a mockery of justice by addressing corruption allegation which were against PPP, while the Punjabi PML(N) was never questioned. The Chief Justice never took a Suo Motto on Shareef’s six billion rupees corruption, he never asked about the ”Qarz utaro Mulk Sawaro” money which was collected by PM Shareef during his second tenure.
Iftikhar Chaudhry also sidelined the Mehran bank scandal because it was a shame for the Army and as well as PML(N). The case pertaining to his corrupt son is now hanging in NAB. Nobody dares to speak against him. The chief justice made a mockery of justice when they only took action against Wahida Shah, while the election commission was never asked about their irresponsibility.
As far as democracy is concerned, The Chief Justice of Injustice has no knowledge as to what democracy is all about. I guess he is also one of those ‘Jali degree wala judge’ (judge with a false degree), having no knowledge regarding the constitutional hierarchy of power. Fortunately, it’s never late to know the truth. Please learn something from your counterpart in India. Here is an apt advice from Justice Markandey Katju regarding the unconstitutional behaviour of the Supreme Court:
“……I therefore fail to understand how proceedings on corruption charges (which are clearly of a criminal nature) can be instituted or continued against the Pakistani President.
Moreover, how can the court remove a Prime Minister? This is unheard of in a democracy. The Prime Minister holds office as long he has the confidence of Parliament, not the confidence of the Supreme Court.
I regret to say that the Pakistani Supreme Court, particularly its Chief Justice, has been showing utter lack of restraint. This is not expected of superior courts. In fact the court and its Chief Justice have been playing to the galleries for long. It has clearly gone overboard and flouted all canons of constitutional jurisprudence.”

A democratically elected prime minister can only be removed through the parliament. The prime minister epitomizes the will of the people, this ‘will’ can only be nullified through the same office that bestows him this power.
Moreover, Iftikhar Chaudhry’s recent decision of nullifying a law passed by the parliament is incomprehensible in any parliamentary democracy. Parliament has the power to call a male, a female and vice versa. Parliament defines the will of the people, it has the power to make laws and abrogate them.
If he wants to become the Ameer-ul-Momineen, who makes all decision by himself, he should leave his office and start a revolution.
It should be noted that there is nothing such a “good laws” or “bad laws”. It is the people’s majority that gives the parliament the power to make new laws. When laws fulfil their purpose, they automatically go into oblivion. Iftikhar Chaudhry must understand that he’s just an individual; he has no authority to nullify the consent of the majority. I’ll suggest him to read an Idiot’s guide to Democracy.
Rule of Law appears to be a factitious idea in our contemporary Supreme Court. The chief justice’s son case is in NAB, while a true Pakistani like Hussain Haqqani is tagged as a traitor. Nawaz Shareef’s corruption cases are sidelined, while Chaudhry tries to dysfunction PPP’s government everyday.
All in all, Iftikhar Chaudhry has lost all moral grounds to remain Pakistan’s chief justice. The sooner he leaves the office, the better for the state.
Dear IK, Despite the fact that I disagree with you on certain points mentioned herein, I must appreciate that you have written a good script.
I just want to draw your kind attention towards two different foundations in constitutional systems, one based on rule of law and one on separation of powers. As you can note that the foundation
behind Pakistan's constitution is based on separation of powers because the state has three pillars separate of each other. If you will analyse these types in detail, you will find the logic behind this principle.
Why the constitution constitutes 3 pillars of state (i.e. Executive, Legislature and Judiciary).
It is based on the principle of ‘SEPARATION OF POWER’ to maintain a healthy ‘SYSTEM OF CHECKS AND BALANCES’.
Why it is needed?
There is a universal truth that ‘power corrupts’ and to prevent the misuse of power, a balanced system of checks and balances is necessary.
Now coming to the present situation in Pakistan, executive and legislature has jeopardised the whole system since more that last 4.5 years in the name of democracy. People’s life has been made a living hell on earth in this period. What options do the people have to get rid of this corrupt mafia consisting of Executive and legislature where the opposition is not a real opposition and nobody bothers to think about the helpless people of the country? It is especially more difficult when the mafia is not willing to quit amicably till the end of its term.
There can be four options as follows:
1- AN EFFECTIVE OPPOSITION: whereby all the opposition parties combine to resist the wrongdoings of the government and to stop wrongful policy / law making (the ideal situation), which unfortunately is not the case in Pakistan;
2- ARMY COUP: where army comes and take the charge, which has unfortunately been done several times in the past and did not sustain in the long run (a very damaging option), and we are lucky that this time it is not the case
3- BLOODY REVOLUTION: people revolt and take the wrong doers out of the power by force (a very dangerous option)
4- JUDICIAL ACTIVISM: Where the Judiciary as the third organ of the state which was constituted with an aim to check the misuse of power comes into action and stops the wrongdoing by using its inherent powers granted by the constitution (a feasible option especially when the opposition parties are not playing their role). The country is again very fortunate that the state organ came forward and started to perform its function.
All the possible solutions in the present circumstances are too damaging for the country except judicial activism. It is the only way which is most appropriate and least damaging for the country at the moment. So the critics must abstain from undermining the positive role that Pakistan’s Supreme Court is playing in the present situation.
The question whether constitution is supreme or parliament is supreme has to be seen in the context of conduct of parliament since the time when the present government took the oath. PPP is treating both the people of the country including opposition parties, and the constitution like a prostitute. The government can take the stance of parliament’s supremacy only in case if it has acted in the true spirit of justice in the interest of people and the country. They only looted the country and betrayed the people and misused the constitution taking the plea and in the cover of so called democracy which is quite visible to everyone. So they deserve a strong shut up call and iron handed accountability.
I agree with you 100% .. and that is exactly what Abidi is saying .. CJ has lost all the moral authority to be in the post.
The story does not start here .. it goes back 20 years .. He used his direct influence to get his son in the medical college on reserved seat – which is against the constitution as it is against the human rights of all other candidates who could not get into medical college as they do not come on merit and do not have a highly placed father to get them into the med school. How can he then pass a judgement that the new contempt of court bill is against human rights as it protects people in high position?
Then he got his son appointed to the govt post as medical officer and then got him transferred to police and FIA etc .. of course Arsalan by himself cannot just go to the Baluchistan secretariat and ask them to be appointed in those departments. It is very obvious that daddy would have made some phone calls.
With the Riaz Malik case out what I believe is that as CJ cannot directly take bribes or favours .. so he has his son as a front man. CJ takes sou-moto action and trap a guy in the judicial process and his son then approach them asking for bribes to get them relief .. CJ then tightens it a bit more so that his son can milk the person a bit more and so on .. unfortunately Malik Riaz broke down after a bit of twists and came out firing his guns .. I wouldnt be surprised if others come forward and tell similar stories.
You are very right in saying that the judiciary does NOT have any right to send an elected representative packing, let alone the prime minister. The supreme court does not have any authority to strike down any law, even if it completely changes the basic constitution.
