Please remember that the basic framework of any law-making in Pakistan is Islam. Instead of getting into any discussion as to whether the Parliament is supreme or the Constitution is supreme, the Supreme Court should decide once and for all that Allah is supreme. The Supreme Court should listen to the arguments from experts to know what is the will of Allah on any particular subject and then make a decision.
The Pakistan Supreme Court is not bound by the decisions of American Supreme or any other court. They are bound only by the Quran and Sunnah and the sooner they say it in so many words the better it would be for everyone. Otherwise a lot of time will be wasted on irrelevant discussions as to who is supreme. For Muslims this is not even an issue. For Muslims only Allah is God, not the Parliament, people, or anyone else. To say otherwise would be, if not open shirk, it would hidden shirk. People need to understand the requirement of La illaha illallah. These are not empty words. They are loaded with meaning.
You are right Allah and His law is supreme but our constitution is not all Islamic.
It has only some articles as per Islamic codes but it does say that the Laws of Allah should be supreme in objective resolution, " Whereas sovereignty over the entire Universe belongs to Almighty Allah alone and the authority to be exercised by the people of Pakistan within the limits prescribed by Him is a sacred trust;"
By saying that constitution is supreme in fact acceptance of supremacy of Allah as per objective resolution.
Why beat about the bush? Why not go straight to the point so that there is no doubt in anyone's mind that for Muslims the sovereignty belongs to Allah. We, Muslims do not believe that Allah is supreme because of the Objectives Resolution or because of this Constitution or that Constitution. In other words even if the Objectives Resolution or the Constitution did not say so in so many words, Allah is still supreme because this is part of our basic belief system.
I do not understand why it should be necessary for lawyers to convince the courts and the Muslims that Allah is supreme because some man-made document says so. Allah is supreme because He says so. That should be enough for us.
